Across the 14 mass torts analyzed, the average duration from first filing to settlement announcement is 6.2 years. The shortest resolved litigation was Vioxx, which reached a $4.85 billion global settlement in just 3 years — driven by Merck's decision to settle after a devastating bellwether verdict. The longest is transvaginal mesh, which has stretched beyond 12 years with some claims still being resolved against multiple manufacturers. Bellwether trial wins by plaintiffs consistently accelerate settlement negotiations. Conversely, cases dismissed on Daubert grounds — as happened with Zantac in 2022 when Judge Rosenberg excluded plaintiffs' expert testimony — can collapse entirely, resulting in zero recovery.

The MDL Formation Bottleneck

JPML consolidation into a multidistrict litigation typically happens 1-2 years after the first individual complaints are filed. Once consolidated, the MDL judge's approach to bellwether trial selection and scheduling is the single most important predictor of timeline.
