Atlanta's Fulton County is the Southeast's most active malpractice venue. Georgia's 2010 elimination of non-economic damage caps has allowed Fulton County juries to award substantial verdicts in catastrophic injury and birth injury cases — particularly against Grady Memorial Hospital (Georgia's largest hospital and a public institution subject to Georgia's ante litem notice provisions) and Emory Healthcare. Georgia's expert affidavit requirement — which must be attached to the complaint at the time of filing with no extension — is one of the strictest pre-filing requirements in the country. Plaintiff attorneys must have expert review completed before the complaint is even drafted. Grady's public hospital status requires a separate ante litem notice to the hospital authority within 30 days of the negligent act, or within 30 days of when it reasonably should have been discovered — an extremely short deadline for government facility claims.
