Medical Malpractice in Charlotte

Charlotte's Mecklenburg County is one of the largest malpractice markets in the Southeast. North Carolina has no non-economic damage cap — the legislature has not enacted one, and constitutional challenges to any cap are likely to succeed given North Carolina's right-to-jury-trial constitutional provision. However, North Carolina's Rule 9(j) certification requirement is one of the most demanding pre-filing requirements in any state: a physician expert must review all existing medical records and provide an opinion that the care was negligent before the complaint is filed, and that certification must be attached. There is no cure period — failure to attach the proper certification at the time of filing results in dismissal with prejudice. This requirement makes early retention of expert consultants critical for Charlotte malpractice cases.
