Charlotte's Mecklenburg County is one of the largest malpractice markets in the Southeast. North Carolina has no non-economic damage cap — the legislature has not enacted one, and constitutional challenges to any cap are likely to succeed given North Carolina's right-to-jury-trial constitutional provision.
