Statute of Limitations

New Jersey Products Liability Act (N.J.S.A. 2A:58C) provides a 2-year statute of limitations for product liability claims. The discovery rule applies — the clock begins when the plaintiff knew or reasonably should have known that Elmiron caused their vision damage. New Jersey has a 10-year statute of repose, but given ongoing Elmiron prescriptions this may not bar current claims.

The Elmiron MDL (No. 2973) is centralized in the U.S. District Court for the District of New Jersey before Judge Brian Martinotti. All federal Elmiron vision loss cases nationwide are transferred here for pretrial proceedings. New Jersey state court claims may proceed separately in Bergen, Middlesex, or Atlantic County Superior Courts. Judge Martinotti has overseen extensive bellwether discovery and Daubert proceedings.
