Where to File in New York
MDL 3014 — New York CPAP/BiPAP cancer claims are consolidated in the Western District of Pennsylvania before Chief Judge Joy Flowers Conti in Pittsburgh. New York plaintiffs file in E.D.N.Y., S.D.N.Y., W.D.N.Y., or N.D.N.Y., then receive a JPML conditional transfer order directing the case to MDL 3014, which has absorbed over 100,000 claims from all 50 states.
New York Statute of Limitations — New York CPLR § 214(5) imposes a three-year limitations period for personal injury claims, and § 214-c provides a discovery accrual rule for latent disease cases: the period runs from when the plaintiff knew or should have known of the injury and its cause. New York's longer window benefits plaintiffs whose CPAP-related cancers have long latency periods.
Transfer to MDL 3014 — After JPML transfer, New York cases proceed through MDL 3014 pretrial management in Pittsburgh. The MDL focuses on PE-PUR foam degradation releasing volatile organic compounds including TDI (toluene diisocyanate) and DMFA (dimethylformamide), which plaintiffs allege caused nasopharyngeal, lung, kidney, liver, bladder, and esophageal cancers.
New York Recall Registration — New York residents with recalled Philips DreamStation, System One, or other affected CPAP/BiPAP devices should register on the Philips patient registration portal. New York State Department of Health issued supplemental guidance encouraging affected users to consult their prescribing physicians about alternative therapy while awaiting replacement devices.
