Liability Considerations in Hoosick Falls
Hoosick Falls gained national attention in 2016 when the EPA placed the community's PFOA-contaminated water on its list of public health concerns, and the New York State DOH began blood-testing residents. The contamination originated from Saint-Gobain Performance Plastics' manufacturing facility (which used PFOA sourced from DuPont) and contaminated the town's drinking water with PFOA at concentrations far above health advisory levels. The 2021 settlement of approximately $65 million compensated a defined class of affected residents. However, class members who were excluded, residents who have since developed new PFAS-linked diagnoses after the settlement class cutoff, and members of the class who accepted settlement amounts that did not fully compensate their injuries all may have legal options. New York's 3-year statute under CPLR § 214-c for toxic substance exposure is among the most favorable nationally for PFAS claimants, and DuPont/Chemours continues to face liability for its supply of PFOA to Saint-Gobain.
