Bayer inherited the Roundup litigation by acquiring Monsanto in June 2018.
Litigation continued over later-filed claims: the Judicial Panel on Multidistrict Litigation reported 1,104 cases pending in the federal MDL on October 1, 2026 (3,925 on September 1, 2026), with tens of thousands more in state courts at earlier stages.
The announcement says the settlement is subject to court approval and contains no admission of liability.
Discovery in the litigation produced the 'Monsanto Papers' — internal documents showing ghostwriting of safety literature and contacts with regulators — now publicly archived in the UCSF Chemical Industry Documents Library. On June 25, 2026, the U.S. Supreme Court ruled 7–2 for Monsanto in Monsanto v. Durnell (No. 24-1068) that FIFRA expressly preempts a state-law failure-to-warn claim that would require a cancer warning on Roundup’s label; Bayer shares rose nearly 19%, their strongest session since 2003.
