Elective Option (Camp Lejeune)

A fixed-payment settlement track the government created for Camp Lejeune claims: $100,000 to $450,000 by disease tier and exposure length, plus $100,000 for wrongful death. Accepting it resolves the claim without litigation.

The DOJ and Navy launched the Elective Option in September 2023 with a two-tier grid: Tier 1 diseases (including bladder and kidney cancer, NHL, and leukemia) at $150K/$300K/$450K by exposure duration; Tier 2 (including Parkinson's and kidney disease) at $100K/$250K/$400K.

Uptake has been slow relative to the claim pool: roughly 2,686 offers approved against more than 408,000 administrative claims by mid-2026. Whether to accept a fixed offer versus litigate is exactly the kind of decision your firm exists to advise on.
