Liability Considerations in Portsmouth

Pease Air National Guard Base in Portsmouth holds a unique place in PFAS history as the first publicly confirmed military PFAS contamination site in the United States. The Pease Community Water System — serving workers, tenants, and visitors at the former base and the current Pease International Tradeport business park — was shut down in May 2014 after PFOS and PFOA were detected at 670 ppt, dramatically above even the then-applicable EPA guidance. The New Hampshire DHHS conducted a formal Community Health Assessment and blood-tested thousands of former Pease workers and users, creating a uniquely documented exposure population with measured serum PFAS data. This blood testing data is extremely valuable for individual PFAS personal injury claims because it eliminates much of the uncertainty about whether an individual was actually exposed and to what extent. Portsmouth residents and former Pease workers who were blood-tested and subsequently developed kidney cancer, testicular cancer, or thyroid disease have among the most straightforward PFAS personal injury claim profiles available. New Hampshire's 3-year statute means those with 2021 or later diagnoses have timely claims.
