What is happening in the California cases against OpenAI?

They are grouped in one coordinated case in San Francisco, called JCCP 5431. A judge granted the request to group them on February 3, 2026. Judge Ethan P. Schulman was later assigned to manage them.

The request to group the cases reached the Judicial Council on November 14, 2025. A judge heard it on January 30, 2026. His order covered 12 cases and paused them until a trial judge was named.

Court rules say the assigned judge must hold a case management conference within 45 days of being assigned and take an active role in every step, through trial. In March 2026, the Judicial Council logged an amended order that assigned the judge and set a case management conference.

None of the records we read sets a trial date. OpenAI says it is responding to the claims in court.

Can a new family’s case join the California group?

It may. A new California case can be added through a request to the judge who runs the group. Other parties can object within 10 days. If no one objects, the judge can decide without a hearing.

The request can come from the court itself or from a party, with a sworn statement showing the case fits. When a case is added, further steps in it are paused in the court where it was filed.

The judge weighs how far each case has moved along and the work the lawyers have done, among other things.

The Judicial Council’s log lists several requests to add cases between April and August 2026, the latest on August 20. It does not say how many were granted.

Where do the Character.AI cases stand?

Families sued Character.AI in federal courts in Florida, Texas and Colorado. In January 2026, the families and the companies they sued told the courts they had agreed to settle, with final terms still to be worked out. The courts have paused or closed the cases while final papers are done. The papers we read do not give amounts.

In Florida, the court closed the Garcia case on January 7, 2026, after hearing it had settled. It gave the parties time to file final papers, and extended that time in April and again on August 4, 2026.

In Texas, the parties said their deal would be part of a global resolution of that case and other similar cases. The court extended its pause to November 10, 2026, for dismissal papers.

In Colorado, one case stays paused, with a joint status report due by October 29, 2026, if it has not been dismissed. In another, the court asked for a status report or dismissal papers by July 31, 2026. A court entry from August 4, 2026, is listed, but we could not read it.

As of October 5, 2026, the newest entries we found on these dockets were from August 2026.

What did the Florida judge decide before the deal?

In May 2025, the judge let most of one family’s claims go forward. She treated the app as a product for claims about its design. She dismissed the mother’s own emotional distress claim. At the mother’s request, she also dropped the claims against Alphabet.

The judge also said she was not prepared to hold that the chatbot’s output is speech. That was an early ruling on the papers, not a finding about what happened.

Because that case settled, there was no trial. No ruling we read decides whether a chatbot caused anyone’s death.

What does this mean if my family is thinking about a claim?

Each family’s case is its own, even inside a group. A lawyer can tell you where your case would be filed and whether it could join the California group. Get any fee terms in writing.

In California, a contract that pays a lawyer a share of what you recover must be in writing. You get a copy signed by both of you, and it must state the fee rate.

Our records page explains how to keep chats and account records, gently and without reading them.

If reading this brings up hard feelings, help is there. You can call or text 988 at any hour, or chat at 988lifeline.org.
