How Mesothelioma Settlements Are Calculated

Mesothelioma settlement values are influenced by the number and financial strength of the trust funds applicable to the case, the number of solvent defendants identified, the disease stage and prognosis at time of filing, the victim's age and economic losses, the jurisdiction (state court vs. federal, and specific county reputation for asbestos verdicts), and the quality and aggressiveness of the legal representation. Unlike typical personal injury cases where a single defendant's insurance policy limits the recovery, mesothelioma cases routinely involve multiple defendants — each contributing a portion of the total settlement — producing combined recoveries far exceeding any single policy limit.

Trust Fund vs. Civil Litigation Timeline

Trust fund claims and civil lawsuits proceed on parallel tracks. Trust fund claims are typically filed within the first 1-3 months of attorney engagement and resolve in 6-18 months, providing interim cash to families managing medical expenses. Civil lawsuits are filed simultaneously and proceed through discovery, expert disclosure, and either settlement negotiations or trial. In jurisdictions with active asbestos dockets (E.D. Pennsylvania, N.D. California, Madison County IL), courts grant priority scheduling to terminal mesothelioma claimants, enabling trial within 6-12 months of filing. Most civil cases settle before trial — settlements typically occur at mediation during pre-trial proceedings.

Frequently Asked Questions

12 QUESTIONS

Mesothelioma is a cancer of the mesothelium — the thin membrane lining the lungs (pleura), abdomen (peritoneum), or heart (pericardium). It is distinct from lung cancer, which originates in the lung tissue itself. Mesothelioma is caused almost exclusively by asbestos exposure and does not arise from smoking. Lung cancer, while also caused by asbestos in some cases, is far more commonly caused by tobacco smoking. Both are compensable through asbestos trust funds and litigation, but mesothelioma claims typically produce higher compensation because the disease is more directly and singularly attributable to asbestos.
