Statute of Limitations
Colorado has a 2-year statute of limitations for personal injury claims (CRS § 13-80-102) with the discovery rule applicable. Colorado courts apply the Daubert standard under CRE 702 and CRE 703. Colorado has modified comparative negligence with a 50% bar, but this standard is generally not determinative in pharmaceutical strict liability claims where manufacturer defect is the primary theory.
