Florida mobile sports betting operates exclusively through the Seminole Tribe's Hard Rock Bet app under the 2021 Gaming Compact between the Tribe and the State of Florida. This creates a unique jurisdictional complexity: the Seminole Tribe holds sovereign immunity that may shield it from certain state court claims. However, the Tribe waived sovereign immunity for certain compact-related disputes, and non-tribal technology vendors (e.g., platform provider Flutter/FanDuel) may not enjoy sovereign immunity. Cases against non-tribal entities may be filed in the Southern District of Florida (Miami/Fort Lauderdale), Middle District (Tampa/Orlando), or Northern District (Tallahassee). The Florida DUTPA (Fla. Stat. § 501.204) provides a private cause of action.
