Florida's sports betting landscape is uniquely complicated by the Seminole Tribe's exclusive mobile sports betting compact, which launched the Hard Rock Bet app in November 2023 after years of legal challenges. Florida is the third-largest state by population and a massive sports market (Dolphins, Buccaneers, Jaguars, Heat, Magic, Panthers, Lightning). The compact structure raises novel questions about tribal sovereign immunity's interaction with consumer protection claims, making Florida a jurisdiction with both high exposure and complex legal dynamics.

Florida mobile sports betting operates exclusively through the Seminole Tribe's Hard Rock Bet app under the 2021 Gaming Compact between the Tribe and the State of Florida. This creates a unique jurisdictional complexity: the Seminole Tribe holds sovereign immunity that may shield it from certain state court claims. However, the Tribe waived sovereign immunity for certain compact-related disputes, and non-tribal technology vendors (e.g., platform provider Flutter/FanDuel) may not enjoy sovereign immunity. Cases against non-tribal entities may be filed in the Southern District of Florida (Miami/Fort Lauderdale), Middle District (Tampa/Orlando), or Northern District (Tallahassee). The Florida DUTPA (Fla. Stat. § 501.204) provides a private cause of action.
