What is the deadline in Louisiana?
Louisiana personal injury SOL (prescriptive period): 2 years for injuries after July 1, 2024 and 1 year for earlier injuries (La. Civ. Code art. 3493.1). Louisiana law generally does not pause the prescriptive period for minors unless a statute says otherwise (La. Civ. Code art. 3468). Wrongful death and survival claims: 1 year from the death or 2 years from the injury, whichever is longer; medical malpractice deaths: 1 year from the death (La. Civ. Code arts. 2315.1, 2315.2, as amended by Acts 2025, No. 176, eff. Aug. 1, 2025). A lawyer can confirm yours.

Louisiana uses modified comparative fault (no recovery at 51% or more fault) for injuries on or after January 1, 2026, and pure comparative fault for earlier injuries (La. Civ. Code art. 2323).
