Maryland is one of only five jurisdictions that retains contributory negligence as a complete bar to recovery. Even 1% plaintiff fault eliminates all recovery. This makes Maryland product liability cases particularly dependent on framing as pure manufacturer defect claims. However, child burn victims benefit from SOL tolling, and the contributory fault of a parent or caregiver is not imputed to the child plaintiff — the child's claim survives regardless of caregiver fault.
