Where to File in New York
New York mobile sports betting is regulated by the NY State Gaming Commission under Chapter 59 of the 2021 Laws. Nine operators are licensed: FanDuel, DraftKings, Caesars, BetMGM, Wynn, PointsBet, Fanatics, Bally Bet, and Resorts World. Cases may be filed in SDNY (Manhattan), EDNY (Brooklyn), or state courts. New York General Business Law § 349 (deceptive business practices) provides a private right of action with treble damages. The SDNY has handled significant consumer class actions against technology companies. New York's 51% operator tax rate — the highest nationally — reflects legislative awareness of gambling's societal costs but has not translated into proportionally stronger responsible gambling requirements.
