Texas has not legalized online sports betting, but gambling addiction litigation still reaches the state because Texas residents use offshore and unlicensed platforms, and DraftKings and FanDuel operate daily fantasy sports products in Texas that plaintiffs allege function as gambling. Texas's large population and active sports culture (Cowboys, Texans, Rangers, Astros, Mavericks, Spurs) make it a massive potential market. The Texas Deceptive Trade Practices Act provides treble damages, and Texas courts have jurisdiction over out-of-state operators marketing to Texas residents.

Texas has not legalized mobile sports betting as of early 2026, but litigation targets DFS (daily fantasy sports) operators and offshore platforms accessible to Texas residents. The Texas Deceptive Trade Practices-Consumer Protection Act (DTPA, Tex. Bus. & Com. Code § 17.41 et seq.) provides treble damages for knowing violations. Texas courts exercise personal jurisdiction over out-of-state operators that direct marketing and products at Texas consumers. Cases may be filed in any of Texas's four federal districts or in state district courts. Harris County (Houston) and Dallas County are plaintiff-favorable venues.
