Statute of Limitations
Virginia has a 2-year statute of limitations for personal injury and product liability claims (Va. Code § 8.01-243). For minor victims, Va. Code § 8.01-229(B)(1) tolls the SOL during minority — child has until age 20 (18 + 2 years) to file independently. Virginia has no product liability statute of repose, which is favorable to plaintiffs. File promptly to avoid any contributory negligence defense being strengthened by delayed investigation.
