Mesothelioma Trial Verdicts — Historic and Recent

Part of the Asbestos / Mesothelioma investigation

The short answer

Mesothelioma trial verdicts have reached into the hundreds of millions of dollars, driven by jury outrage over decades of corporate suppression of asbestos hazard knowledge. Even average trial verdicts — in the $10M-$30M range — dwarf typical settlement amounts, giving mesothelioma attorneys leverage in pre-trial negotiations.

Why Mesothelioma Verdicts Are So High

Mesothelioma juries are uniquely sympathetic because of three converging factors: (1) the victim is dying from a preventable occupational disease caused by a product the manufacturer sold for profit; (2) documentary evidence — internal corporate memos, medical studies, and industry correspondence — proves that manufacturers knew of asbestos health hazards decades before they warned workers; and (3) the victims are typically elderly men who worked hard their entire lives and whose families are left devastated. This combination produces "nuclear verdict" potential — awards far exceeding typical personal injury outcomes — that gives plaintiffs' attorneys significant settlement leverage even before trial begins.

Notable Mesothelioma Verdicts

Historic mesothelioma verdicts include: $250 million against W.R. Grace and Sealed Air Corporation (NJ 2003) for household asbestos exposure; $80 million verdict against Owens-Illinois for insulators in Los Angeles; multiple $30M-$50M verdicts in Madison County, Illinois and E.D. Pennsylvania against brake pad manufacturers and pipe insulation suppliers. Recent verdicts (2023-2025) have averaged $15M-$25M for contested pleural mesothelioma cases at trial, with punitive damage components adding $5M-$50M in cases with documented corporate concealment evidence. The threat of these verdicts — combined with the sympathetic plaintiff and strong documentary evidence — drives pre-trial settlement negotiations toward the $2M-$8M range in most contested cases.

FAQ

Frequently Asked Questions

12 QUESTIONS

Mesothelioma is a cancer of the mesothelium — the thin membrane lining the lungs (pleura), abdomen (peritoneum), or heart (pericardium). It is distinct from lung cancer, which originates in the lung tissue itself. Mesothelioma is caused almost exclusively by asbestos exposure and does not arise from smoking. Lung cancer, while also caused by asbestos in some cases, is far more commonly caused by tobacco smoking. Both are compensable through asbestos trust funds and litigation, but mesothelioma claims typically produce higher compensation because the disease is more directly and singularly attributable to asbestos.
