Laurie Selber Silverstein · U.S. Bankruptcy Court for the District of Delaware · U.S. Bankruptcy Judge, bar date order in the Exactech case

Finding: The December 10, 2024 order set February 7, 2025 at 4:00 p.m. Eastern as the general deadline to file claims. A holder who did not file on time is not treated as a creditor for voting and payment under a plan.

The short answer

What was the bankruptcy claim deadline?
The court set February 7, 2025, as the main deadline to file a claim in Exactech’s bankruptcy. Injury claims had no separate date. Claims could be filed online or by mail. [14]
Does that date still matter for the trust?
Yes. The trust’s claim rules require a bankruptcy claim that was filed on time, or that the court treats as on time. A second step comes later. [15]
What if I did not file by February 7, 2025?
Ask a lawyer to look at your facts. A claim filed after that date is treated as disputed, and the court decides any objection to it. Claims against other companies can have their own time limits. [16]
Do other time limits still apply?
Yes. The time limit depends on the law and the type of claim. Some limits come from state law. A lawyer can check which one applies to you. [12]

What was the bankruptcy claim deadline?

The court set February 7, 2025, as the main deadline to file a claim in Exactech’s bankruptcy. Injury claims had no separate date. Claims could be filed online or by mail.

Judge Silverstein’s order set the deadline at 4:00 p.m. Eastern time. It said people who did not file on time would not take part in votes or payments under a plan. Government claims had a later date.

Federal court guidance explains why this step matters. Someone whose claim the company did not list, or listed as disputed, generally must file a claim form to share in a plan.

Does that date still matter for the trust?

Yes. The trust’s claim rules require a bankruptcy claim that was filed on time, or that the court treats as on time. A second step comes later.

When the trust is ready to take claim forms, it will give notice. Under its rules, a basic claim form sent within 60 days after that notice counts as on time, if the claim was still within its time limit when that limit was paused. As of October 5, 2026, we had found no such notice.

What if I did not file by February 7, 2025?

Ask a lawyer to look at your facts. A claim filed after that date is treated as disputed, and the court decides any objection to it. Claims against other companies can have their own time limits.

Under the plan, a late claim is not allowed unless a final court order overrules an objection to it. Objections to injury claims are handled by the settlement trust, not by the company’s wind-down officer.

The plan’s order sending injury claims to the trust does not, by itself, block claims against some other parties. Other court orders protect the buyer of Exactech’s business. The bankruptcy date alone does not answer every question about your situation, so ask a lawyer who else, if anyone, may be responsible.

Do other time limits still apply?

Yes. The time limit depends on the law and the type of claim. Some limits come from state law. A lawyer can check which one applies to you.

A federal court guide says that finding a time limit takes legal research. When a federal law sets no limit, the guide points to the state law for the most similar claim. Do not assume the recall date sets your deadline; ask a lawyer when your time limit started.

Which dates should I bring to a lawyer?

Bring the date of your implant surgery and the date problems began. Add any revision date and any claim you filed. Bring letters from Exactech or the court.

If you filed a claim in the bankruptcy, keep the confirmation. Kroll, the former claims agent, left that role on September 2, 2026, and was told to send its records to Omni Agent Solutions. A lawyer can ask where your claim stands.

What happens after I ask for a date check?

If a lawyer takes your request, they can review your dates and records and explain your options. Get the fee terms in writing first. Asking does not file a claim for you.

Under the ABA model rule, a contingent fee agreement, one paid from a recovery, must be written and signed by the client. It must say which expenses you would owe even if you lose. Keep copies of everything you send and receive.

Find out where you stand.

The review is free and private. Asking for it doesn’t commit you to anything.
