Idaho Code § 5-311 governs wrongful death claims, and § 6-1603 caps non-economic damages at $250,000 in all civil cases. This cap applies to wrongful death non-economic damages — grief, loss of companionship, and mental anguish. Economic damages (lost earnings, medical expenses, funeral costs) are uncapped. Ada County (Boise) handles the largest volume of Idaho wrongful death cases.
