Statute of Limitations
Kentucky imposes a 1-year statute of limitations for personal injury claims (KRS § 413.140). This is one of the shortest limitation periods in the nation. The discovery rule applies to latent pharmaceutical injuries — the clock begins when the plaintiff discovers or should have discovered the injury and its cause. Kentucky courts follow the Daubert standard for expert testimony under KRE 702.
