Statute of Limitations
12 O.S. § 95(A)(3) provides a 2-year limitations period for personal injury claims in Oklahoma. The discovery rule applies — in hernia mesh cases, the clock starts when the plaintiff discovered or should have discovered the mesh-related injury and causation. No statute of repose applies to Oklahoma product liability claims. Oklahoma plaintiffs frequently participate in MDL 2846 and MDL 2511 in S.D. Ohio.
