Non-medical wrongful death cases — vehicle accidents, workplace fatalities — are uncapped. Minnehaha County Circuit Court (Sioux Falls) handles South Dakota's highest volume of wrongful death cases. Agricultural machinery accidents, highway fatalities, and construction deaths drive South Dakota's wrongful death docket.
