MDL 3014 — formally In re: Philips Recalled CPAP, Bi-Level PAP, and Mechanical Ventilator Products Liability Litigation — is pending in the U.S. District Court for the Western District of Pennsylvania under docket 2:21-mc-01230-JFC. Chief Judge Joy Flowers Conti has been the presiding judge since the MDL's formation in October 2021, with Magistrate Judge Patricia L. Dodge handling discovery matters. Pittsburgh was selected as the MDL venue in part because Philips Respironics is headquartered in nearby Murrysville, Pennsylvania.
The MDL entered 2026 with general causation Daubert hearings and bellwether trial scheduling as the primary litigation drivers. Philips has aggressively challenged plaintiffs' expert witnesses on the causal link between foam VOC exposure and specific cancer diagnoses. Court rulings on Daubert motions — either admitting or excluding plaintiffs' causation experts — will be the single most important development in determining settlement pressure and timeline. The Zantac MDL's 2022 dismissal (after causation experts were excluded) is Philips's blueprint; CPAP's direct chemical evidence is considered significantly stronger.
