Florida reduced its personal injury statute of limitations from 4 years to 2 years effective March 2023. The discovery rule applies, but Florida plaintiffs who have not yet filed should consult an attorney. Florida is one of the top states for mesh implantation volume given its large population of older women.
Statute of limitations in Florida: 2 years from discovery (Fla. Stat. § 95.11(5)(a)) for negligence; product liability claims have 4 years from discovery (§§ 95.11(3)(d), 95.031(2)(b)). 2023 tort reform shortened the negligence SoL for causes of action accruing after March 24, 2023. The discovery rule matters in mesh cases because complications—including mesh erosion and chronic pain—often appear years after implantation. Plaintiffs who received a mesh device a decade ago but were only recently diagnosed with a complication may still have a viable claim. An attorney can evaluate your specific implant date and diagnosis date against the applicable filing deadlines.
